the seller...unless they were representing you as a BUYERS AGENT!!
OVERVIEW:
Unless contracted as a Buyers Agent REALTORS® act as sub agents for sellers, meaning they are working
for the seller and with the buyer. When working with
buyers as customers, REALTORS® are still responsible to treat
them honestly, fairly & give full disclosure of material facts about
the property. However, when representing buyers as clients, REALTORS®
now become a BUYERS AGENT and are obligated to provide their client
with six duties under agency law: Loyalty, Disclosure, Accountability of
Funds, Obedience, Reasonable Care and Diligence and Confidentiality, as
well as many other client level services that are beneficial to the buyer.
HOW CLIENT LEVEL SERVICE IS OFFERED TO BUYERS:
When a home owner decides to sell their home, they sign a listing contract with the listing agent. This sets up a contractual agreement that turns that REALTOR®: into a SELLERS AGENTS - the seller is now a client. A buyer becomes a client when the buyer signs a BUYER BROKER contract.
The REALTORS® is now representing the buyer and acting in their best interest.
Information can now be supplied to the buyer to ensure they are making the
best decision in the purchase of their new home. Information such as the
comparable value of properties in the neighborhood, showing recent "sold"
prices, prices of similar homes on the market, number of days on the market,
attributes & disadvantages of the house and neighborhood and most importantly
arrive at an offer price based on the above factors. Subagents of the seller can only
suggest full price offers. Help in negotiating is reason alone to contract
a buyer's agent!

HOW TO DO IT:
Buyer Broker representation is available upon request. Specifics such as length
of contract & retainer fees, if appropriate, will be discussed, AS PER STATE LAW REQUIREMENTS before
services can be rendered and before you decide to sign. The retainer fee is applied to your closing costs
and the commission will generally be paid by the seller. In cases of a seller attempting to sell their own homes, you may be obligated to pay the commission but the negotiated purchase price will take that into account so that the total sales price and closing costs will be as if the seller were to pay the commission.
